General and Definitions
These terms are the only terms on which Silver Fox Tractor Spares Ltd contracts with the customer and his purchase of goods. "Goods" shall be deemed as any materials or parts supplied to the customer.
Our Products
Parts supplied by Silver Fox Tractor Spares Limited are not manufactured by the original equipment manufacturer. Original manufacturer's name, part numbers and descriptions are quoted for reference purposes only and are not intended to indicate or suggest that our replacement parts are made by the original equipment manufacturer. Photos and information used in our listings may have been supplied by the replacement part suppliers/manufacturer.
Specifications
The specifications of the goods shall be those stated in the Company's current catalogue.
Whilst specifications are considered to be correct at the date of printing, the Company reserves the right to change specifications of the goods and their packing and presentation without prior notification.
Unwanted Purchased Goods can be returned up to 30 days from date of arrival for credit (under the Distance selling regulations) and must be returned in a clean, unused condition, in original box/packaging and fit for resale.
Gaskets must be unopened, Books must be clean and un thumbed.
Sealed Toys/Goods must be returned with all Silver fox Tractor Spares/ Factory seals unbroken to receive a full refund of the total purchase price
Items must be returned within 30 days of arrival. any return shipping costs are the responsibility of the Purchaser
If your order contains a fault/error or is incomplete/Damaged Silver Fox Tractor Spares Limited must be notified directly (Not via 3rd party) within 48 Hours of receiving the order
In the case of Damaged goods photographs showing damage to the goods and packaging is required within 7 days of delivery to allow insurance claims to proceed, And the damaged goods should be returned to Silver Fox Tractor Spares Ltd within 14 days of Delivery
Refunds will only be given when goods supplied are returned to Silver fox Tractor Spares Ltd
Return shipping costs and any other costs or charges involved with the goods return are the responsibility of the purchaser, any charges incurred on arrival back to the UK charged to Silver Fox Tractor Spares Ltd will be deducted from the refund amount .
Silver Fox Tractor Spares Ltd retains the right to instruct the Carrier to Dispose of the Goods if local taxes and import duties are unpaid by the Purchaser/Receiver by the time limit issued by the carrier /shipping agent and no goods refund would be issued
15% Handling/Restocking charge will be charged on all cancelled orders and returned goods for credit for Business Customers on total invoice Value

Unpaid Orders
Order that are not completed through the checkout system within 7 days will be deleted from the system.
Bank Transfer
All payments received must match invoice total. Any costs charged by the paying Bank must be paid by the customer. Please put Order Number in as Reference/Message
Cheques
All cheques must be paid in Pounds Sterling & payable to "Silver Fox Tractor Spares Ltd" . Please write Order Reference number on the back of the cheque.
Import duty
Customers outside the UK are liable for all import duties & local taxes & any extra charges applied to their order after leaving the United Kingdom.
The Discount Voucher and sale price reductions can be withdrawn or changed by Silver Fox Tractor Spares Ltd at any time without giving prior Notice and can only be used online at www.silverfoxtractorspares.com and cannot be used in conjunction with any other offer or discount scheme
Gift Vouchers issued by Silver Fox Tractor Spares Ltd can only be can redeemed online at www.silverfoxtractorspares.com and cannot be used in conjuction with any other discount scheme.
Only one gift voucher can be redeemed per transaction
Gift Vouchers are not Redeemable for Cash
Free postage offer does not apply to any orders that including , Rear Tyres, Wings/Fenders, Engine kits or Short Engines, Free postage offer only applies to English mainland excludes Scotland & Highlands
Shipping Rates
Shipping rates for large or bulky items may incur an additional surcharge, due to extra handling charges and fuel surcharges imposed on us by the carriers.
Lost Parcels
Parcels sent with Royal Mail are not classed as lost until 3 weeks after sending date. Customers whose parcels have not arrived in this period should notify Silver Fox Tractor Spares Ltd. Any claim for refund or replacement will not be accepted until after this period.
Next day cut off times
Next Day delivery cut off time is 12. o’clock midday, any orders received after this time will be shipped the following morning on a next day service, next day service is only available to UK Mainland excluding Scottish Highlands.
Retention of Title and Risk
Goods are the responsibility of the customer as soon as they are delivered by the company, or its agent, to the customer.
Goods shall remain the complete property of the company as legal and equitable owner until such time as the customer shall have paid the full price. The deposit of a cheque shall not be deemed as payment until clearance through the Company's Bank. Until such payments are made the customer acknowledges that he is in possession of goods as bailee for the company.
Until the customer becomes owner of the goods he is to store them separately from his own or those of any person in a manner identifiable, safe and conditioned.
The customers’ right to possession shall cease if they, not being a company, commits an available act of Bankruptcy or if they, being a company does anything or fails to do anything which would entitle any person to present a petition for winding up. The company may for the purpose of recovery enter upon the premises where they are stored or where they are reasonably believed to be stored and may repossess the same.
The Customer shall be at liberty to agree to sell on the goods on the express condition that such an agreement to sell shall take place as bailees for the Company, whether the customer sells on his own account or not and that the proceeds thereof are held in trust for the Company and at all times are identifiable as such.
Delay and Force Majeure
Whilst every effort will be made to comply with any quoted dates given for dispatch or delivery, time shall not be of the essence and the Company shall not be liable for any loss or damage caused by delay or failure by the Company in obtaining goods from the Company's own suppliers, or any loss or damage caused by strikes, lockouts, trade disputes, transport delays, shortages of material, breakdowns, fire, accidents and/or any causes whatsoever beyond the company's control. Such delay shall not constitute a breach or repudiation of the contract.
In the event of performance of the contract being frustrated or prevented by reason of war, civil commotion or the operation of any statute, order, regulation or promulgation made by any statutory or duly constituted authority whether in the UK or elsewhere, the Buyer shall accept and pay for all goods delivered, work executed and expenses incurred in connection with the contract up to the date of such event, and the Company shall from such date be under no further liability under the contract.
Warranties
The Company warrants that the goods will correspond to their specification and will be free from defects in materials and workmanship for a period of 12 months from the date of delivery, or in the case of goods which have a shorter working life as determined by the Company, three months from the date of delivery ("The Warranty Period").
If the Company receives written notice during the Warranty Period from the Buyer of any breach of the above warranty then the Company shall at its own expense and within a reasonable time after receiving such notice repair, or at its option replace the goods or otherwise remedy such defect. The Buyer will, at the request of the Company, return such defective goods to the Company carriage paid.
The Company shall be under no liability under the above warranty:
(a) In respect of any defect in the goods arising from any drawing, design or specification supplied by the Buyer;
(b) In respect of any defect arising from fair wear and tear, wilful damage, negligence of the Buyer, abnormal working conditions, failure to follow the Company's instructions (whether oral or in writing), misuse or alteration or repair of the goods without the Buyer's approval, or improper storage.
(c) Where the goods are transported to the Buyer at the Buyer's risk and the defect occurred during transit;
If the Company fails to comply with such obligations its liability for such failure shall be limited to the contract price of the goods.
The express terms of these Conditions of Sale are in lieu of all warranties, conditions, terms, undertakings, and obligations implied by statute, common law, custom, trade usage, course or dealing or otherwise, all of which are hereby excluded to the fullest extent permitted by law. The United Nations Convention on Contracts for the International Sale of Goods (Vienna, 1980) shall not apply to orders for goods.
Recycling & Packing Policy
At Silver Fox Tractor Spares Ltd our packing policy is to try to recycle and re-use as much incoming packaging as possible on the inside of our outgoing parcels to help reduce the carbon footprint on each of our sale items. We use the very best quality packing materials and pack to the highest standard to protect the contents on their, sometimes, very long journey.
Telephone numbers will be passed on as requested by most couriers and always when outside the UK mainland. Telephone numbers may be put on the outside of the parcel to help couriers make the delivery as quickly as possible.
Construction
These Conditions of Sale shall be subject to and shall be construed in accordance with English law and the High Court of Justice in London shall have non-exclusive jurisdiction over any dispute which may arise hereunder unless the parties agree otherwise in writing.
NOTHING CONTAINED HEREIN SHALL EFFECT THE STATUTORY RIGHTS OF THE CONSUMER
